Vijai’s office building gets stop work notice

Dy Collector says construction is ‘illegal’ and is being carried out without conversion sanad

In an interesting development, deputy Collector, Margao Ajay Gaude on Tuesday issued a show cause notice to Usha Sardesai, wife of Fatorda MLA Vijai Sardesai to stop the “illegal development/constructions” of the office building on grounds that the construction of the ground-plus one structure admeasuring a plinth area of 130 sqmts is being carried out without the conversion sanad.   

The deputy Collector has now directed Ms Sardesai to remain present in the office on December 20 at 3 pm in person or duly authorized agent/pleader and show cause as to why action under section 33 of the Land Revenue Code shall not be taken against the illegal development/construction in the property.   

The deputy Collector’s action comes after the Salcete Mamlatdar submitted a report that Ms Sardesai has allegedly carried out construction of the ground-plus one structure without obtaining the conversion sanad.   

“Such unauthorized conversion of use of agricultural land to non-agricultural purpose is contravention under section 30, 31 and 32 of the Goa Land Revenue Code 1968 and rules and liable for penalty under section 33 of the Code”, the show cause notice issue stated.   

The office of the deputy Collector had initiated an inquiry into the mater following directions issued by the district 

THE SHOW CAUSE NOTICE
Construction of structure admeasuring 130 sqmts being carried out without conversion sanad   
Ms Sardesai to remain  present on December 20 at 3 pm in person or duly  authorized agent/pleader and show cause as to why action shall not be taken 
Such unauthorized conversion of use of agricultural land to  non-agricultural purpose liable for penalty under  section 33 of the Code
THE COMPLAINT
SGPDA had issued construction permission against all laid down rules and without  following the mandatory procedures of compliance
Developer did not produce conversion sanad while seeking  permission 
SPGDA had overlooked this very important  requisite while granting permission   
Though complaints were made  PDA did not act and  on the contrary the Member Secretary had allowed the developer to  progress with the illegal construction
