AAP demands implementation of Law dept order dissolving panel

With the Law department dissolving with immediate effect the Committee constituted way back in 2013 to scrutinise applications from those intending to purchase property in Goa under the provisions of Foreign Exchange Management Act (FEMA), the Aam Admi Party (AAP) on Monday submitted a memorandum to the Salcete Sub Registrar demanding immediate implementation of the latest order.

AAP Salcete President Ernest Moraes led a delegation to the Salcete Sub Registrar Domnick Pereira and submitted the government’s order doing away with the 2013 order constituting the panel and empowering the Sub Registrars to deal with all cases pertaining to purchase of properties by Goans, who are Persons of Indian Origin.

The Sub Registrar, however, told the delegation that the Salcete office has so far not received any order from the State Registrar, adding that his office will start implementing the order only as and when received by the office.  

Moraes told The Goan that the BJP government in 2013 had issued the order dated February 8 constituting the panel to go into case of buying of properties by Goans, who are OCIs or Persons of Indian Origin (PIO). 

“This order had meted out huge harassment to the Goans, who wanted to buy land and property as per the Indian law. The AAP had handed over a memorandum to the Law Minister Francis D’Souza, drawing his attention to the harassment meted out to Goans intending to buy flats or land in their own State,” Moraes said, expressing satisfaction that the government has now done away with the committee and has empowered the Sub Registrars to handle all such cases.  

By the recent order issued by Under Secretary Diwan Rane, The State Registrar cum head of Notary Services has been directed to send all the pending files for NOC of FEMA to the concerned Civic Registrars cum Sub Registrars (CRSRs).  

The order stated that the CRSRs shall ensure that no transaction of immovable property is registered without verifying the FEMA regulation compliance if the transaction involves any of the categories mentioned in FEMA 

regulations.  

As per the order, the CRSRs shall maintain a register with details of such permission given by them for presentation and registration of documents for transfer of property involving persons referred under FEMA regulations.
