Docs rule out further autopsy on Bismarque's body

PANAJI: The two-member medical panel consisting of the Dean of Goa Medical College and another expert in the field has opined that “it is not possible to carry out any further autopsy” on the body of activist Bismarque Dias.
They have however recommended that a “radiological examination” of the body which the public prosecutor told the court will be conducted.
The family of the deceased had challenged the order of the Goa Human Rights Commission directing that the funeral rites of the deceased be held on the ground that if funeral rites are undertaken it will impede and hamper the criminal investigation as the body will not be available.
The family, however, agreed that the situation of the body remaining in the morgue cannot continue perpetuity and an immediate end to this situation is beneficial of all.
The High Court then, asked the family and the learned State, as to how the impasse could be ended. After much deliberations at the bar, both the counsel, upon instructions, suggested that a two Members panel, consisting of the Dean, Goa Medical College and a Senior Expert in the subject suggested by the should be constituted.
They agreed that this Panel will decide whether the body needs to be kept in the morgue till the entire investigation is complete or it is not necessary any more discussion as to whether to reach the above conclusion further autopsy is necessary agreed to leave that decision to the Panel.
The State agreed that if the panel opines that further autopsy is needed, the State will accept the recommendations of the panel, while on the other hand, the family also agreed that, if the panel opines that further autopsy is not required, they will accept the report.
The court made it clear that they have undertaken this exercise only because of the peculiar facts and circumstances of this case and because of the consensus between the parties, and that it was not a reflection on the merits of the investigation, in any manner.
