High Court relief for Kirbhat in Nuvem

The Bombay High Court at Goa issued a fresh order this time staying the reservation of Ward 10 in Nuvem village on grounds that there was only a 0.32 percent population of Other Backward Class voter within that ward in the village.

The order issued based on a petition filed by one Domingo Fernandes, comes on the back of several similar orders by the Bombay High Court at Goa affecting the reservation in several panchayats in the State clouding the entire election process.   
Fernandes argued that at the highest there were not more than 20-30 voters belonging to OBC category in the Ward 10 as compared to 530 voters in the general category and therefore the reservation of the Ward 10 for OBC was grossly arbitrary, illegal and contrary to the constitutional scheme for reservations.  
“There was no marked change in the OBC population in the panchayat area as to justify the reservation of the Ward 10 for OBC candidates,” he argued.
